>> Obamacare is a disaster. It's virtually dead.>> Well, not yet, but a handful of states are looking to do what Republicans and Congress couldn't, kill the Affordable Care Act. Led by Republican attorneys general and Texas and Wisconsin, a coalition of 20 states are suing the federal government, claiming Obamacare is no longer constitutional.
Their argument lies in a key part of Trump's tax plan, which repealed the penalty a person had to pay for not having health insurance. By doing away with that so-called mandate, the states say the healthcare law itself is invalid. Obamacare has so far survived several legal challenges. The Trump administration left to undermine it through executive and regulatory actions.
The Justice Department did not immediately respond to a request for comment on whether the administration would defend the law in court.
